What damages are available in an employment discrimination case?

As an employee bringing a claim for discrimination, you’re eligible for a number of different damages. One is back wages. That’s the loss of your employment. You’re also entitled to the difference between if you gainfully become re-employed, the difference in pay between your new job and your former employer. You’re also entitled to receive any benefits that you’ve lost, loss of opportunity, example would be maybe 401K contributions, those type of incidental. The law also allows you to recover for what’s called compensatory damages on the non-economic side, meaning pain and suffering, humiliation, making you whole for what you’ve experienced as a victim of discrimination. You can also ask for and recover punitive damages in more egregious cases. Our firm has been successful in obtaining those although they are rare.
