Workplace Safety Violation: Employer in Florida Cited for Serious Violation After Cashier Injured in Late-Night Shooting Incident

On August 14th, 2024, the Occupational Health and Safety Administration (OSHA) cited an employer in Central Florida for a serious workplace safety violation. An employee of Circle K Stores Inc. was shot and seriously harmed in a late-night incident in Orlando. OSHA determined that the employer’s substandard safety efforts contributed to the incident.

What Happened: Employee of Circle K Stores Shot During Robbery 

In the early morning hours of January 19th, 2024, two men entered a Circle K store location on Silver Star Road in Orlando, Florida. They pointed firearms at the cashier and screamed for the register to be opened. The cashier instinctively moved back from the register. One of the assailants fired a shot and struck the employee in the shoulder. Thankfully, the victim suffered the attack—although they sustained a serious injury. Notably, the incident occurred near Orlando’s Pine Hills neighborhood, which has a higher crime rate than the national average.

 OSHA Determined Safety Failures Contributed to Employee’s Injuries

  • Sign Saying Register Limited at $50: Finally, OSHA advises that stores install a visible notice indicating that the cash register contains a limited amount of cash.

 The Agency is Seeking Maximum Federal Fine for Workplace Safety Violation 

OSHA is recommending that the maximum allowable statutory penalty—$16,131—be imposed on the employer for the serious workplace safety violations. The employer is contesting the fine. What exactly safety precautions should be put in place depends on the specific industry.
